The Safety, Rehabilitation and Compensation Act 1988 (SRC Act) establishes a no-fault national workers compensation scheme.

The national workers compensation scheme (known as Comcare) applies to:
​

Commonwealth and ACT public servants
-
Employees of Commonwealth and ACT statutory authorities and corporations
-
Some private sector employees of national companies who have elected to be part of the scheme including telecommunications, postal, freight, transport and logistics, airlines and banks. The current list of Comcare Licensees can be accessed here.

Compensation is payable for injuries that result in death, incapacity for work or impairment, including:

Physical injuries arising out of or in the course of employment.

Psychological injuries arising out of or in the course of employment
-
A disease or the aggravation of a disease that was contributed to, to a significant degree, by the emplee's employment.
​
However, no compensation is payable for injuries suffered as a result of reasonable administrative action taken in a reasonable manner in respect of the employee's employment.

Compensation payable can include:

Incapacity payments for loss of income

Medical treatment

Lump sum compensation

Household support and attendant care services

Death benefits and funeral expenses

If your claim is disputed you generally have 60 days to request an internal review of the decision. If you are not satisfied with the review decision, you have 60 days from the date of that decision to apply to the Administrative Appeals Tribunal (AAT) for further review.
